A product recall is one of the highest-stakes operational decisions a company will face — and the instinct to wait for more data almost always makes the outcome worse. The CPSC treats companies that self-report differently from those that are compelled to act, and litigation outcomes follow the same pattern. The relevant question is not "is this definitely dangerous?" but "is the risk material enough that a reasonable company would act?" When 8% of 380,000 units may be defective, the answer is almost never to wait.
